Esta Ley de Inclusión Escolar Chile es una Ley que protege y evita que los alumnos sean expulsados de las distintas instituciones del país por diferentes motivos como el de su aspecto o su situación económica y social.
Dicha Ley de Inclusión Escolar Chile es la Ley N° 20.845 del país y fue promulgada por la presidenta Michelle Bachelet en el año 2015, específicamente el 29 de mayo, entrando en vigencia en dicho año y cumpliéndose en todas las instituciones del país.
¿De qué se trata la Ley de Inclusión Escolar?
La Ley de Inclusión Escolar Chile es una ley promulgada por la presidenta Michelle Bachelet el 29 de mayo del año 2015 y la cual elimina el lucro en los distintos establecimientos educativos.
Con esto, se termina con el sistema de colegios subconvencionados, los cuales tendrán que elegir entre ser colegios particulares o ser fundaciones sin ningún tipo de fin de lucro por parte del Estado.
Dicho esto, esta Ley prohíbe que las instituciones seleccionen a sus alumnos por medio de pruebas de ingreso, condición económica o por rendimiento académico. Tampoco pueden basarse en su religión u otros.
Sin embargo, de este aspecto quedan absueltas las instituciones emblemáticas, quienes podrán elegir solo al 30% de su población estudiantil en base a ciertos criterios, así como las instituciones con programas especiales (deportivas, artísticas, entre otros).
Por otra parte, sin importar el nivel de estudio, esta Ley también le prohíbe a las instituciones la suspensión de los alumnos por su situación económica, por el estado civil de sus padres o por embarazo, así como por tener dificultades de aprendizaje.
Los estudiantes tampoco podrán ser suspendidos por su forma de vestir o se les podrá exigir la compra de libros; sin embargo, las pautas de las instituciones deberán ser respetadas por los representantes de los alumnos.
Finalmente, antes del proceso de matriculación, la institución deberá reunirse con los padres interesados de la matriculación donde expondrán de forma transparente las reglas de la institución y sobre los pagos y actividades extracurriculares de la misma.
Si los representantes o apoderados sienten que ninguna de las condiciones expuestas anteriormente, son cumplidas por las instituciones, pueden realizar una denuncia ante la Superintendencia Escolar para que sea aplicada la Ley Zamudio.
¿En qué consiste la Ley Zamudio del 2022?
También conocida como “Ley antidiscriminación” es una ley que establece medidas para acabar con la discriminación hacia una persona. Ella cuenta con el número de Ley 20.609 y fue creada en el año 2012.
Esta Ley Zamudio cuenta con 18 artículos permanentes los cuales modificaron el Estatuto Administrativo y el Estatuto para Funcionarios Municipales y el Código Penal, surgiendo a partir de la discriminación que vivió un joven de la comunidad LGBTIQ+.
En cuanto al contenido que se encuentra en dicha Ley, podemos señalar las definiciones de la discriminación de todo tipo, así como excepciones a dicha discriminación, haciendo énfasis en ciertos derechos como el N°4 (derecho a la intimidad).
Así mismo, en dicha Ley se puede encontrar todo el proceso judicial a realizar para recuperar el derecho perdido cuando se cometa algún tipo de discriminación hacia cualquier persona.
